Noisy neighbors can create an uncomfortable living environment. The Ohio Landlord/Tenant law does not create a clear remedy for tenants when the noisy neighbor is another tenant.
The landlord does have authority under ORC 5321.11 to give the tenant creating the disturbance a thirty (30) day notice to correct a tenant violation of a tenant obligation at ORC 5321.05. ORC 5321.05(A)(8) states:
"A tenant who is a party to a rental agreement shall: Conduct himself and require other persons on the premises with his consent to conduct themselves in a manner that will not disturb his neighbors' peaceful enjoyment of the premises."
Many landlords prefer to stay away from any disputes between tenants.
You may give your landlord written notice of the problem, stating that your position is that the noise is creating an uninhabitable environment for you. ORC 5321.04 obligates a landlord to do that which is necessary to keep the premises in fit and habitable condition. If the landlord refuses to take action to remedy the situation, you may look to the ORC 5321.07 remedies of:
Since the initial violation is the tenant violating his/her obligation to not infringe on neighbor's quiet enjoyment, the landlord may argue that he/she is not obligated to take action, but merely has that option. The Courts may or may NOT choose to allow rent depositing, or the other ORC 5321.07 remedies to tenants under these circumstances.
